The short version. We are experienced growers and small business owners, not licensed professionals. Everything we publish is educational, based on what has worked for us, and offered without any guarantee of results. We earn affiliate commissions and occasionally run sponsored content, and we disclose it. Our software product, Microgreen Tracker, runs on a completely separate website with its own separate policies. Please read the full page below, and consult a qualified professional before making health, legal, financial, or major business decisions.

1. Scope and the properties this covers

This Disclaimer and Disclosures page is published by On The Grow, LLC, a Texas limited liability company. In this document, "we," "us," and "our" mean On The Grow, LLC.

This page applies to:

  • Our website at www.onthegrow.net, including the online store, blog, and any digital downloads
  • Our YouTube channel and any video content we publish
  • Our social media accounts, community posts, comments, and direct messages
  • Our email newsletters and customer emails
  • Our courses, book, guides, and other educational materials
  • Our software product, Microgreen Tracker, at www.microgreentracker.com, but only to the limited extent described in Section 11. Microgreen Tracker is governed primarily by its own separate policies.

This page is a disclosure and disclaimer document. It is not our full contract with you. Our Terms of Service, Privacy Policy, Refund and Return Policy, and Shipping Policy govern purchases and use of our sites, and this page is incorporated into and forms part of our Terms of Service.

2. General disclaimer

All information we publish is provided for general informational and educational purposes only. We provide it in good faith. We make no representation or warranty of any kind, express or implied, as to the accuracy, adequacy, validity, reliability, availability, or completeness of any information we publish.

Your use of our content, and any reliance you place on it, is solely at your own risk. To the fullest extent permitted by applicable law, we are not liable for any loss or damage of any kind arising out of your use of our content or your reliance on any information in it. See Section 23 for the full limitation of liability.

3. No professional advice and our background

Our content is not a substitute for professional advice, consultation, diagnosis, or services in agriculture, horticulture, plant pathology, nutrition, medicine, food safety, business, accounting, tax, insurance, finance, or law.

What we are not

We are not, and we do not hold ourselves out as:

  • Licensed agricultural consultants or agronomists
  • Certified horticulturists, plant pathologists, or plant specialists
  • Nutritionists, registered dietitians, physicians, or other health professionals
  • Food safety inspectors, certified food safety managers, or certified food handlers
  • Business consultants, financial advisors, accountants, tax preparers, insurance advisors, or attorneys
  • Accredited instructors or certified educators, and none of our courses or materials confer any accredited credential, certification, license, or continuing education credit

What our content is actually based on

Everything we publish comes from:

  • Our own hands on experience growing microgreens since 2019
  • Our own experimentation and testing in our own facility and conditions
  • Publicly available research, extension publications, and third party resources
  • What has worked in our specific growing environment and in our specific business

We do not hold formal degrees, certifications, or licenses in agriculture, horticulture, nutrition, food safety, business, or related fields. We share what we have learned as growers and small business owners.

No professional relationship is created

Reading our content, buying a product, enrolling in a course, emailing us, commenting on a video, or receiving a reply from us does not create any professional, advisory, fiduciary, consulting, agency, partnership, joint venture, employment, or attorney client relationship between you and us.

Please consult a qualified professional

Before acting on anything we publish, and especially before making decisions involving health or diet, food safety and sanitation, regulatory or licensing requirements, business structure or financing, taxes, insurance, contracts, or a significant purchase of equipment or supplies, we strongly recommend you consult a qualified, licensed professional in the relevant field and in your own jurisdiction.

4. No guarantee of growing results

We share methods, techniques, and products that have worked well for us. We do not guarantee you will get the same results.

Growing outcomes depend on many factors outside our knowledge and control, including:

  • Environmental conditions such as temperature, humidity, airflow, light quality, and light duration
  • Water quality, mineral content, pH, and treatment
  • Seed quality, variety, viability, age, storage, and supplier
  • Your skill level, experience, and consistency
  • Sanitation and hygiene practices in your space
  • Whether products are used according to the instructions provided
  • Local climate, season, altitude, and building conditions
  • Pests, pathogens, and contamination sources present in your environment

Results will vary from person to person, setup to setup, and season to season. Nothing we publish should be read as a promise that a particular method will produce a particular yield, germination rate, harvest weight, shelf life, appearance, or flavor for you.

We also cannot diagnose problems remotely with certainty. Guidance we give in comments, direct messages, emails, or community posts is general in nature, is based on the limited information you give us, and is not an individualized professional assessment of your setup.

5. Business and earnings disclaimer

Some of our content discusses running a microgreens business, pricing, customers, and revenue. Please read this section carefully.

  • We make no earnings claims and no guarantee of income. Any figures we mention, whether ours or someone else's, are illustrative and specific to that person and that situation.
  • Our results are not typical. We have an established brand, a large audience, years of operating history, and a specific local market. Those advantages are not transferable and should not be treated as a baseline.
  • Most people who start a business do not replicate someone else's results. Many businesses do not become profitable. Your outcome depends on your market, competition, location, pricing, costs, capital, effort, timing, sales ability, and factors nobody can predict.
  • We are not offering a business opportunity, franchise, or investment. We sell physical products, a software subscription, and educational materials. We do not sell territories, distributorships, guaranteed buy back arrangements, or any promise of a market for what you grow.
  • Nothing we publish is financial, tax, accounting, insurance, or legal advice. Business structure, licensing, permits, sales tax, food handling registration, product liability, and insurance requirements vary by state, county, and city. Get local professional advice.

You alone are responsible for your business decisions and for any money you spend, invest, or lose.

6. Advertising, affiliate, and sponsorship disclosures

We make money in several ways. We want you to know exactly what they are.

Amazon Associates Program

On The Grow is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com and affiliated sites.

As an Amazon Associate, we earn from qualifying purchases.

Other affiliate relationships

We participate in other affiliate and referral programs. Companies we may have an affiliate relationship with include, but are not limited to, growing supply retailers, seed companies, equipment manufacturers, and software providers.

What an affiliate link means

  • If you click one of our affiliate links and make a purchase, we may earn a commission from that merchant
  • The commission is paid by the merchant, not by you
  • Your price is the same whether or not you use our link
  • Commission rates vary by merchant and by product category and can change without notice
  • We may also earn a commission through affiliate networks or sub networks even where we are not the direct affiliate of the merchant

Sponsored content and paid partnerships

From time to time we create sponsored content or enter paid partnerships. When we do, we disclose it clearly and conspicuously within the content itself, before or at the start of the endorsement, in language such as:

  • "This video is sponsored by [Brand]"
  • "Paid partnership with [Brand]"
  • "We were compensated to create this content"
  • "[Brand] sent us this product for free"

We do not rely on this page alone, or on a platform's built in label alone, to satisfy that disclosure. We also disclose free or gifted products, discounts and credits, review units, early access, travel, and any other thing of value we receive.

Our own products

When we recommend or feature products sold by On The Grow, we obviously have a financial interest in your purchase. We think that is self evident, and we say so anyway.

Editorial independence

We are not paid to give positive opinions. When we accept sponsorship or earn a commission:

  • We only recommend products we have actually used, tested, or researched and believe in
  • Our opinions remain our own and are not subject to brand approval
  • We disclose drawbacks and limitations as well as strengths
  • We do not choose a recommendation solely because it pays a higher commission

FTC compliance

We aim to comply with the Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising, 16 C.F.R. Part 255, and with the FTC's Rule on the Use of Consumer Reviews and Testimonials, 16 C.F.R. Part 465. If you believe any of our content is missing a disclosure that it should have, please tell us at info@onthegrow.net and we will correct it.

7. Reviews, testimonials, and results shown

How we handle reviews

We commit to the following:

  • We do not write, buy, commission, or publish fake reviews or fake testimonials
  • We do not offer or accept compensation conditioned on the sentiment of a review
  • If a reviewer received a free product, a discount, an entry into a giveaway, or any other incentive, we disclose that with the review
  • If a review comes from us, an employee, a family member, or anyone with a material connection to us, we disclose that connection
  • We do not suppress, delete, or reorder honest negative reviews about our products in order to create a misleading overall impression. We may remove content that is spam, off topic, unlawful, abusive, contains personal information, or violates our community guidelines.
  • We do not misrepresent third party review ratings or use deceptive "as seen in" style badges

What a testimonial does and does not tell you

Any testimonial, success story, before and after photo, or case study we feature:

  • Reflects that individual's experience in their own conditions
  • Is not necessarily representative of what most customers experience
  • Is not a guarantee, warranty, or prediction of your results
  • Is provided for illustration only

8. Our products, proper use, and safety

What we sell

Our catalog consists of reusable silicone grow mediums, trays, tray clips and accessories, growing kits, and digital and printed educational materials. We do not sell seed. Any seed you grow is sourced by you from a third party, and we have no control over and take no responsibility for its quality, viability, treatment, cleanliness, or labeling.

Follow the product instructions

Each product page and each product's included instructions contain care, use, and safety information specific to that item. Those instructions control. Please read them before use. In particular, and without limiting anything else we publish:

  • Our silicone grow mediums are not dishwasher safe, and they must not be cut, trimmed, or otherwise modified. Cutting or modifying a grow medium voids any applicable warranty and may make it unsafe or unusable.
  • Our tray clips should be removed before washing trays and cleaned with rubbing alcohol only. Repeated water exposure makes them brittle and they will break.
  • Use of a product in a manner inconsistent with its instructions is at your own risk, and we are not responsible for the outcome.

General safety

Growing involves water, electricity, tools, and equipment. You are responsible for safe setup and operation. Please take basic precautions:

  • Keep water away from electrical connections, use ground fault protection where appropriate, and follow the manufacturer's instructions for lights, fans, pumps, heat mats, and timers
  • Never leave heat producing equipment unattended in a way the manufacturer does not permit
  • Ventilate your space and manage humidity to reduce mold and mildew
  • Wash hands and sanitize surfaces, trays, and tools
  • Keep growing equipment, small parts, and supplies away from children and pets

Third party products we discuss

We have not tested every product on the market. Our recommendations reflect products we have personally used or researched. There are very likely excellent products we simply have not tried. When we describe a third party product's specifications, features, certifications, or manufacturer claims, we are relying on information supplied by the manufacturer or seller and cannot independently verify all of it. Specifications, formulations, sourcing, and prices change without notice. Always verify current details directly with the manufacturer or seller before purchasing.

We do not warrant or guarantee that any recommended product will meet your needs, perform as it did for us, remain available, remain at a listed price, or retain the specifications it had when we reviewed it.

Testing limitations

When we test products, we test in our environment, over a limited period, and often not across every feature or use case. Long term durability frequently cannot be assessed within the window of a review. Your experience may differ from ours.

9. Food safety and regulatory compliance

Microgreens are a fresh, ready to eat food that is often consumed raw. Food safety matters and it is your responsibility.

  • We are not food safety inspectors or certified food safety professionals. Food safety practices we share are what we do, not a validated food safety plan.
  • Regulations vary widely by location. Requirements from the U.S. Food and Drug Administration, your state department of agriculture or health, and your county or city health department may apply to you, and they may differ depending on whether you grow for yourself, sell direct to consumers, sell wholesale, or sell to restaurants.
  • You are responsible for determining and following the rules that apply to you, including any produce safety, cottage food, farmers market, licensing, labeling, water testing, recordkeeping, or inspection requirements.
  • Sanitation is essential. Wash hands, sanitize trays and equipment, use clean water, and control your environment.
  • Contact your local health department or state department of agriculture for the requirements in your area before you sell food to anyone.

We are not responsible for contamination, illness, spoilage, product loss, recall, enforcement action, or any other consequence arising from how you grow, handle, store, label, or sell food.

10. Nutrition and health information

Any nutritional information we mention is drawn from publicly available research, third party sources such as the USDA, and general published information about microgreens.

We are not nutritionists, registered dietitians, or health professionals. Nothing we publish is nutritional advice, medical advice, diagnosis, or treatment, and nothing we publish is intended to diagnose, treat, cure, or prevent any disease.

If you have a health condition, are pregnant or nursing, take medication, or have any allergy or dietary restriction:

  • Talk to your physician or a registered dietitian before adding new foods to your diet
  • Understand that some people are allergic or sensitive to particular seeds, plants, or plant families, and that some plants and plant parts are not safe to eat at all
  • Never eat anything you cannot positively identify, and never assume the edible microgreen stage of a plant means the mature plant is edible, or the reverse
  • We cannot advise you on whether microgreens are appropriate for your specific health situation

If you experience a reaction to any food, seek medical attention.

11. Microgreen Tracker is a separate service

Please read this section if you use Microgreen Tracker. Microgreen Tracker is our product, but it is a completely separate service from our store. It runs on a different website, uses different accounts, uses a different payment system, and is governed by its own separate policies. Buying something on one does not give you anything on the other.

What it is

Microgreen Tracker is a web based grow tracking and small business recordkeeping application published by On The Grow, LLC. It is available only at www.microgreentracker.com and runs in a web browser.

Microgreen Tracker is not distributed through the Apple App Store, Google Play, or any other app store. We are not affiliated with, endorsed by, or sponsored by Apple, Google, or any app marketplace. If you find an application claiming to be Microgreen Tracker in an app store, it is not ours. Please report it to us.

What this separation means for you

  • Separate accounts. An account on one site does not create or give access to an account on the other. Your login credentials are not shared between them.
  • Separate payments. Purchases on onthegrow.net are processed through our store checkout. Microgreen Tracker subscriptions are billed through a separate system. Charges, receipts, invoices, and payment methods are handled independently.
  • Separate refunds and cancellations. A refund or cancellation on one has no effect on the other. Subscription cancellation is handled inside your Microgreen Tracker account and is subject to the app's own billing terms.
  • Separate policies. The Terms of Service, Privacy Policy, cookie practices, data handling, and billing terms published at www.microgreentracker.com govern your use of the app. Where those policies and this page conflict as to the app, the app's own policies control.
  • No bundling. Buying a product, kit, book, or course from our store does not include a Microgreen Tracker subscription, and a Microgreen Tracker subscription does not include any store product, course, or discount, unless we state that explicitly in writing for a specific offer.
  • Separate support. Please send app questions through the support channel listed on microgreentracker.com so they reach the right place. Store questions go to info@onthegrow.net.

What the app does and does not do

Microgreen Tracker is a recordkeeping and organizational tool. It stores the information you enter and helps you keep track of it. It is not:

  • An agronomic, horticultural, or plant health advisory system
  • A food safety, traceability, HACCP, or regulatory compliance system, and it should not be relied on to satisfy any legal recordkeeping requirement
  • Accounting, bookkeeping, tax, invoicing, or financial software of record
  • A substitute for your own records, or for professional advice of any kind

Any timings, dates, projections, yields, pricing references, reminders, or suggestions the app displays are estimates or defaults based on general information. They are not tailored to your environment and they are not guarantees. You are responsible for verifying anything the app tells you before acting on it, including any harvest date, food safety judgment, price, or amount owed.

Availability, changes, and beta features

  • We do not guarantee uninterrupted or error free operation. The service may be unavailable due to maintenance, updates, outages, or third party failures.
  • Features, plan limits, and pricing may change. Current plans and pricing are the ones published on microgreentracker.com at the time of your purchase or renewal, and those published terms control over any figure mentioned in a video, post, or older page.
  • Some features may be released as beta or preview and may change or be withdrawn.
  • We may modify, suspend, or discontinue the service, in whole or in part, in accordance with the app's Terms of Service.

Your data

  • Back up your own records. Use any available export function and keep your own copies. We do not guarantee that data will be preserved indefinitely, recovered after loss, or retained after your account is cancelled, terminated, or expires.
  • You are responsible for what you put in. The accuracy of your records depends on the accuracy of your entries.
  • If you store information about your own customers, including names, contact details, orders, deliveries, or amounts owed, you are responsible for that information and for complying with any privacy, data protection, and consumer protection laws that apply to you. You must have the right to enter that information and you must handle it lawfully.
  • How we handle the data you store is described in the Microgreen Tracker Privacy Policy on its own site.

Subscriptions

Paid Microgreen Tracker plans are recurring subscriptions that renew automatically until cancelled. Before you subscribe, the app discloses the price, the billing interval, the fact that it renews automatically, and how to cancel. You can cancel at any time from within your account, and cancellation is at least as easy as signing up was. The complete billing, renewal, refund, and cancellation terms are published at www.microgreentracker.com and are the terms that apply.

12. Courses, books, and digital products

  • Our courses, guides, book, and downloads are licensed to you for your personal, non commercial use. You may not resell, redistribute, share access, republish, or use them to create a competing course or product.
  • Course access is personal to the purchasing account. Sharing login credentials is not permitted and may result in access being revoked.
  • Course content may be updated, reorganized, or replaced. We may add, remove, or change lessons.
  • We aim to keep purchased content available, but we do not guarantee perpetual availability of any platform or hosted material. Download and keep any materials that are offered as downloads.
  • Discount codes are subject to their own terms, may expire, and may be withdrawn or changed at any time.
  • Refund eligibility for digital products is governed by our Refund Policy. Because digital content is delivered immediately, different rules may apply than for physical goods.
  • Completing a course does not confer any certification, license, accreditation, or credential.

13. Accessibility statement

We want everyone to be able to use our website, our store, and our content, including people who use screen readers, keyboard navigation, magnification, captions, or other assistive technology.

Our goal

We are working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, and we use WCAG 2.2 Level AA as our forward target. These guidelines are the standard most commonly referenced in connection with the Americans with Disabilities Act.

What we are doing

  • Reviewing our pages, product listings, and templates for keyboard accessibility, color contrast, form labeling, heading structure, and link clarity
  • Adding meaningful alternative text to images that convey information
  • Providing captions on video content where we are able to
  • Correcting accessibility barriers as we identify them or as they are reported to us
  • Taking accessibility into account when we choose themes, apps, and third party tools

Known limitations

We are a small, two person business and our site is built on third party platforms. Some content is served by third parties whose code we do not control, including our e-commerce platform, installed apps, embedded video players, payment processors, and social media embeds. Some older content, including older videos, images, and PDFs, may not yet meet our target. We do not claim that our website is currently fully conformant with any accessibility standard, and this statement is a description of our ongoing efforts rather than a certification.

If any part of our website, content, or checkout is difficult or impossible for you to use, please contact us and we will work with you to give you the information, the product, or the assistance you need through another channel, at no additional cost to you.

14. Trademarks and intellectual property

Our marks

"ON THE GROW," our leaf logo design, and our slogan "Do you beleaf in magic?" are trademarks of On The Grow, LLC.

Scope of protection

Our federal registrations give On The Grow, LLC exclusive nationwide rights to use the registered marks in connection with the goods and services covered by those registrations, which include fresh microgreens and related agricultural goods, online retail services in hydroponic agriculture, gardening kits, and educational and entertainment programming about microgreens and hydroponic agriculture. We also claim common law rights in our marks in connection with goods and services we actually offer.

Uses that require our written permission

Without our express written permission, you may not:

  • Use "On The Grow," "OnTheGrow," "On-The-Grow," or a confusingly similar variation as a business name, trade name, DBA, product name, domain name, social media handle, or username in the microgreens, hydroponics, agriculture, farming, gardening, or growing supply fields, or in connection with educational content in those fields
  • Use our marks, logo, or trade dress in advertising, marketing, packaging, labeling, or promotional materials
  • Reproduce, copy, redistribute, resell, or publicly post our copyrighted content, including videos, blog posts, images, graphics, course materials, PDFs, book content, and email content
  • Create derivative works based on our content
  • State or imply that you are affiliated with, endorsed by, sponsored by, certified by, or partnered with On The Grow, LLC when you are not

Uses that are generally fine

Trademark law permits certain uses without permission. Generally, you may:

  • Refer to us or our products truthfully in a review, comparison, news report, commentary, criticism, parody, or academic discussion
  • Share photos of products you bought from us, and tag or mention us on social media
  • Discuss our content in forums, groups, and communities
  • Link to our website or content

What is not permitted, whatever the label put on it, is any use that is likely to confuse people about the source of goods or services, falsely suggests endorsement or affiliation, uses our marks as your own identifier, or trades on our reputation. If you are unsure, ask us first.

Licensing

We do not currently license our marks to third parties. If you want to discuss a collaboration, partnership, or licensed use, contact us in advance at info@onthegrow.net. Unauthorized use is unauthorized even when it is well intentioned.

Enforcement

We monitor and enforce our trademark and copyright rights. Where appropriate we send cease and desist notices, submit platform takedown and brand protection complaints, oppose conflicting trademark applications, and pursue other remedies available to us.

Remedies available to a trademark owner under federal law can include injunctive relief, recovery of the infringer's profits, actual damages, and costs, and in exceptional cases attorney's fees, under 15 U.S.C. § 1117(a). Cases involving counterfeit marks and cases involving bad faith registration of confusingly similar domain names carry their own additional statutory remedies. Copyright infringement carries separate remedies under the Copyright Act. Nothing in this paragraph is a statement about any particular person or dispute, and nothing here is legal advice to you.

15. Official channels and verifying who you are dealing with

On The Grow, LLC is owned and operated by CJ Vaughn and Mandi Vaughn. These are our only official channels:

We are not responsible for anyone else using our name

If you encounter a business, website, social account, listing, advertisement, or individual using "On The Grow" or a similar name in the microgreens, agriculture, farming, gardening, or growing supply fields, they are not affiliated with us unless we have said so on one of the official channels listed above.

We are not responsible for, and expressly disclaim any liability arising from:

  • The conduct, statements, business practices, or customer treatment of anyone using our name or brand without authorization
  • The quality, safety, or performance of any product or service offered by such a party
  • Any grant, award, funding, partnership, endorsement, or achievement claimed by such a party
  • Any loss, financial or otherwise, you incur in dealing with such a party
  • Any damage to our reputation arising from such use, as against you or anyone else

How to verify

Before doing business with anyone who presents themselves as On The Grow:

  • Check that the domain is exactly onthegrow.net for the store, or microgreentracker.com for the app
  • Check that email correspondence comes from an @onthegrow.net address
  • Check our official website and social accounts above for any announcement of the partnership or affiliation being claimed
  • Email us at info@onthegrow.net and simply ask. We will tell you.

We announce our own partnerships, sponsorships, collaborations, grants, and awards on our own official channels. If you have not seen it there, please verify before relying on it.

Similar names are not automatically impersonation

To be fair to others, we should say plainly that a similar name is not by itself proof of wrongdoing. Comments, questions, photos, reviews, and other content posted by users on our website, videos, or social accounts are the responsibility of the people who post them. Those opinions are theirs, not ours, and their presence does not mean we endorse or have verified them.
