However, we do not guarantee growing success or specific outcomes, as results depend on environmental factors, user technique, water quality, seed quality, and other variables unique to each grower. All sales of growing products are subject to the disclaimers in Section 21.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.   • You received exactly what was listed in the product title, description, and your order confirmation
  • The confusion arose from seeing reference photos of individual components, old product photos of items we no longer sell or related products

  • Digital products (eBooks, courses, PDFs, downloadable content) are licensed, not sold, and are subject to U.S. and Texas law regardless of your location
  • Physical products shipped internationally remain subject to these Terms, though you may have additional consumer rights under your local laws

By purchasing from On The Grow from outside the United States, you acknowledge and agree that Texas law applies to your purchase and that you understand your rights under both these Terms and your local consumer protection laws may differ.

Trademark Protection Scope

These federal trademark registrations provide On The Grow, LLC with exclusive rights to use the "ON THE GROW" mark in connection with:

  • Fresh microgreens and agricultural products (Class 031)
  • Online retail services in hydroponic agriculture (Class 035)
  • Educational and entertainment services related to agriculture and growing (Class 041)

Unauthorized Use is Prohibited

The following uses of "ON THE GROW" or confusingly similar marks are strictly prohibited without our express written permission:

In Commerce or Business:

  • Using "On The Grow," "OnTheGrow," "On-The-Grow," "@somefarmname_OnTheGrow," or any confusingly similar variation as a business name, trade name, or DBA
  • Operating any business in agriculture, hydroponics, microgreens, farming, gardening, lawn care or related industries under our trademarked name
  • Using our marks in advertising, marketing, or promotional materials
  • Using our marks on products, packaging, or labels
  • Using our marks in domain names, social media handles, or online usernames

In Specific Industries (Likelihood of Confusion): The "ON THE GROW" trademark is specifically protected for use in:

  • Microgreens production, sales, or education
  • Hydroponic agriculture and supplies
  • Indoor/outdoor gardening products and services
  • Agricultural education and entertainment
  • Lawn care services
  • Online retail of agricultural products
  • Any related or overlapping agricultural, lawn care, farming, or growing industries

Using "ON THE GROW" or similar marks in these industries creates a likelihood of confusion with our registered trademarks and constitutes federal trademark infringement.

Content & Intellectual Property:

  • Reproducing, copying, or redistributing our copyrighted content (videos, blog posts, course materials, images)
  • Using our logo, brand identity, or trade dress without authorization
  • Creating derivative works based on our content
  • Falsely claiming affiliation with or endorsement by On The Grow, LLC

Legal Rights & Enforcement

As the registered owner of these federal trademarks, On The Grow, LLC has the exclusive right to:

  • Use these marks in commerce throughout the United States
  • Prevent others from using confusingly similar marks
  • Take legal action against infringers
  • Seek damages, injunctions, and attorney's fees for trademark violations

We actively monitor and enforce our trademark rights. We have successfully pursued legal action against unauthorized users in the past, including cease and desist letters and trademark infringement claims.

Federal Trademark Infringement

Unauthorized use of our registered trademarks may constitute:

  • Federal trademark infringement under 15 U.S.C. § 1114 (Lanham Act)

Nutrient density and nutritional content of microgreens and sprouts are influenced by numerous factors entirely outside our control and unrelated to the growing medium itself, including but not limited to:

SEED-RELATED FACTORS:

  • Seed variety and genetics
  • Seed quality and freshness
  • Seed storage conditions before purchase
  • Natural variation between seed batches

ENVIRONMENTAL FACTORS:

  • Light quality, intensity, spectrum, and duration
  • Temperature during growing
  • Humidity levels
  • Air circulation and quality
  • Geographic location and altitude

WATER-RELATED FACTORS:

  • Water quality and mineral content
  • pH levels of water
  • Presence or absence of chlorine, fluoride, or other additives

FERTILIZER & NUTRITION INPUTS:

  • Type of fertilizer used (if any)
  • Fertilizer concentration and application method
  • Nutrient solution composition
  • Timing of fertilizer application

GROWING PRACTICES:

  • Harvest timing (days to maturity)
  • Growing cycle length
  • Seed density/spacing

Because these factors vary significantly from grower to grower, location to location, and crop to crop, nutritional content will vary regardless of growing medium used.

General Information About Microgreens (Not Our Claims)

Based on publicly available research and scientific studies conducted by third parties (not by On The Grow, LLC):

  • Microgreens are generally considered to be nutrient-dense when compared to mature vegetables of the same variety, primarily because they are harvested at a very young stage when nutrient concentrations are high
  • Studies have shown that certain microgreens can contain higher levels of vitamins, minerals, and antioxidants than their mature counterparts
  • Hydroponic growing methods (which can include growing on inert mediums with nutrient solutions) have been shown in some studies to produce crops with comparable or sometimes higher nutrient density than soil-grown crops, depending on growing conditions
  • Controlled environment growing (using grow lights, controlled temperature, etc.) can sometimes produce more consistent nutritional results than outdoor growing, according to some research

Course Access: Online courses remain accessible as long as they are actively maintained on our platform. We reserve the right to modify, update, or discontinue course offerings, though active students will receive reasonable notice when possible.

No Refunds After Access: As stated in our Refund Policy, digital products are non-refundable once accessed. For our Microgreen Masterclass course specifically, refunds are only available if you have not accessed content beyond the two locked introductory modules. We can and will review your account access history to verify eligibility.

Third-Party Payment Services: Our checkout may offer third-party payment plan options such as Shop Pay Installments (powered by Affirm), Klarna, Afterpay, PayPal Pay Later, or other buy-now-pay-later services. These are not payment plans offered by On The Grow, LLC.

When you choose a third-party payment plan:

  • The financing company pays us in full immediately
  • We fulfill your order as a standard purchase
  • Your payment agreement is between you and the financing company
  • We have no access to, control over, or responsibility for your payment plan
  • We cannot modify, cancel, or adjust your installment terms

Returns & Refunds: If you return a product purchased with a payment plan:
